Itâs within CMAâs discretion to assess new RMS and lift interim orders. I donât think the CAT actually has the power to prevent the CMA from doing so.
So if the CMA and MS wanted this new deal to have gone through, they didnât have to care about the appeal at all.
CMA could have lifted the interim order and allowed MS to close. Itâs in their discretion.
I think this is a case of the CMA trying to have their cake and eat it too.
Just how I see it: Its CMAs fault for not doing this during the investigation period. They refused to discuss and deal.

The CAT is saying is if itâs a new RMS, why does the current decision / order matter? Thatâs what I make of it.
CMA never would have even investigated if not for sony.
Theyâve also said if its a new RMS then its two months to approval - and closure in the UK requires that approvalâŚif youâve notified then you canât close until a decision has been made.

I think the judge here is trying to steer the CMA and MS to say that because of the recent Sony deal THAT is the material change in circumstances that would let him adjourn the CAT case.
Basically he doesnât want to delay the CAT case based on âwell we might have an agreementâ he wants to delay it because âMS signed a deal with Sony that materially changes thingsâ. CMA and MS should just go with that and get this thing adjourned.
Im listening to the judge with the viewpoint of, like a lawyer, hes asking questions and making statements that are building to provide a framework for what his closing statemnts are going to be and from that POV Im feeling something unprecedented is about to happen.
No, itâs about the CMA having brought a case. They brought a case cus of sony and used cloud to justify it.
I think its 2 months in full about 40 working days - but whilst it can maybe sped up probably not significantly as they need to draw a panel together, do the analysis and write the report.
More the CMA because they want to show that the decision they made in April was correct.
