According to Hoeg they can delay for another 30 days or something like that. This is sounding like months, sounding even worse than the appeal period.

It’s within CMA’s discretion to assess new RMS and lift interim orders. I don’t think the CAT actually has the power to prevent the CMA from doing so.

So if the CMA and MS wanted this new deal to have gone through, they didn’t have to care about the appeal at all.

CMA could have lifted the interim order and allowed MS to close. It’s in their discretion.

I think this is a case of the CMA trying to have their cake and eat it too.

Just how I see it: Its CMAs fault for not doing this during the investigation period. They refused to discuss and deal.

Is it within the CMA’s discretion to allow a new RMS and subsequently approve it without the usual process (that is at least 2 months) - cos CAT seems to be saying ‘probably isn’t’??? Though I think there is some hedging going on there.

The CAT is saying is if it’s a new RMS, why does the current decision / order matter? That’s what I make of it.

CMA never would have even investigated if not for sony.

They’ve also said if its a new RMS then its two months to approval - and closure in the UK requires that approval…if you’ve notified then you can’t close until a decision has been made.

This hearing in the UK is about cloud.

Is it at least two months? Seems like 40 days is the usually, but probably can sped up significantly.

I think the judge here is trying to steer the CMA and MS to say that because of the recent Sony deal THAT is the material change in circumstances that would let him adjourn the CAT case.

Basically he doesn’t want to delay the CAT case based on ‘well we might have an agreement’ he wants to delay it because ‘MS signed a deal with Sony that materially changes things’. CMA and MS should just go with that and get this thing adjourned.

Im listening to the judge with the viewpoint of, like a lawyer, hes asking questions and making statements that are building to provide a framework for what his closing statemnts are going to be and from that POV Im feeling something unprecedented is about to happen.

No, it’s about the CMA having brought a case. They brought a case cus of sony and used cloud to justify it.

I think its 2 months in full about 40 working days - but whilst it can maybe sped up probably not significantly as they need to draw a panel together, do the analysis and write the report.

More the CMA because they want to show that the decision they made in April was correct.

Microsoft is basically just the yes-man and try to help the CMA to save face.

Microsoft gets the approval and CMA was “correct”. Win-win I guess

Its sort of unbelievable how much a mess the CMA have made not only today but through the whole process.

What we need now is Alan Sugar to burst through the door finger raised ‘it is with regret that you are fired’.
