So here is the judge now concerned that discussions between MS and CMA to effectively ‘amend’ the final order are not legal - wouldn’t involve others or wider consultation of stakeholders and public.
And this is a big problem. CMA have been useless.

I know that CMA used fake cloud concern to mask their shit with Sony.

Also I don’t think MS and ABK has “officially” notified the CMA of a new RMS since the interim order is still in place.
There is so much wiggle room in the laws that the CMA has multiple tools at their disposal to pass the deal today if they wanted.
Which one is it!?

I mean nobody knows. If the judge agrees to a stay and MS notifies the CMA of a new merger situation and the CMA accept that - technically its down to the CMA’s timetable and how quick they are or can be. And some of that is problematic based on the CAT today - ie need for public consultation, stakeholder engagement etc…
I think the MS lawyer said something like (paraphrasing) offering a new deal to the CMA in a few days.
Looks like the CMA and Microsoft were in talks around the FTC injunction.
So maybe in a few days ?
Probably already posted, but they really should just agree its all moot cause of Sony deal.

MS would rather close over than offer more money. If the ABK board says no to extension, then they will close over the CMA.
Activision want this deal as much as MS, they aren’t going to get another buyer
If the deal is as good as done and it’s just a case of waiting, they aren’t going to screw things up for themselves
