Judge said MS will acquire ABK, its not if but when. Hopefully it ends today. I can’t take much more of this

The judge cannot in reality ‘end it today’ - its not in his sole discretion. He’d need a hearing and have the two other judges with him to consider the position and case law before making a ruling like that.

He could if the CMA is willing to drop the april order

They might just have to close over the CMA as I don’t think they can delay it for months without a renegotiation. This needs to get settled today in this court.

CMA and MS would have to unilaterally do that. But CMA seem like they won’t without the formal notification from MS. Why MS haven’t sent this is beyond me.

Whilst that would remove the TRO the problem with that is MS have notified the CMA of a RMS - and therefore until the CMA have concluded their investigation - MS can’t close.

MS can close if it’s a new investigation.

You can’t blame the CMA or CAT alone here. MS haven’t notified. So the ability to remove the order isn’t there because they haven’t done their bit.

MS should have just closed over the CMA. They have shown from their initial immediate blocking and doubling down after the EU decision that they are not going to be fair or cooperative.

I’m confused ? Clearly CMA was not going to admit they were fully wrong today.

Why did MS agree to pause if they weren’t going to bring anything concrete ? Wouldn’t that of made this much easier ?

Maybe MS lawyers have something in the tuck though so we’ll see.

They could as its only the Boards that would need to extend it. It does not require a shareholder vote. Other acquisitions like AT&T and DirecTV extended their deadline twice without renegotiations.

Yep. UK has been acting dumb ever since Brexit. CMA is just childish. No one should take them seriously, they are obviously not in a good place.

No - MS reached out. Offered new deal. Negotiations. Agreement in principle. Soft agreement.

But MS haven’t submitted the notification formally. Which is poor. They must have reasons. But still. Not CMA’s fault. If MS had this hearing would be super quick.
