Whilst that would remove the TRO the problem with that is MS have notified the CMA of a RMS - and therefore until the CMA have concluded their investigation - MS can’t close. And if they did that the process would take longer than amending the final order.

Yes, CMA wants to eat their cake and have it too. Get out of the awful april decision that will be destroyed in court, but keep the block to put time pressure on MS

Isn’t it that by declaring this a new RMS the old one becomes defunct and the process before CAT is gone?

Whereas what the CMA and MS want is to keep the existing RMS alive and therefore the CAT process alive - but just adjourned?

That’s how I see it.

I don’t think this judge can just decide today its a new RMS and do anything unilaterally I think he’s just exploring the situation.

CAT can at the hearing. I assume that’s what he was talking about.

Shouldn’t they have done their investigation with an answer before coming to court. They pretty much shafted MS until both CAT refused their delay and the FTC lost. This is a problem they created, and they are not taking responsibility.

MS haven’t submitted their new RMS…so the CMA can’t do that…

Don’t think you’d need to name a buyer. Just that you’d undertake an ‘appropriate divestment’. Far as I know. But I mean this is unprecedented.

Judge said MS will acquire ABK, its not if but when. Hopefully it ends today. I can’t take much more of this
