Whilst that would remove the TRO the problem with that is MS have notified the CMA of a RMS - and therefore until the CMA have concluded their investigation - MS can’t close. And if they did that the process would take longer than amending the final order.
Im not watching or listening to this, but is the gist that if the judge quashes it, MS wouldnt be required to divest, so they are trying to kind of have it both ways?

Shouldn’t they have done their investigation with an answer before coming to court. They pretty much shafted MS until both CAT refused their delay and the FTC lost. This is a problem they created, and they are not taking responsibility.

Don’t think anything here has been bad for the deal’s chances. I’m not convinced they’ve been good for the prospect of a closure in next few weeks though.
