If Microsoft divest the cloud unit in uk that seems like some forward thinking for Microsoft as it stops the CMA from really being able to block anything going forward because of cloud as Microsoft wouldn’t have cloud gaming in the uk.

I said the same thing in this thread not long ago using that exact line. it’s like the FTC waits till he last minute on purpose to appeal or do anything.

It would be outrageous for the 9th to grant a stay when Judge Corley herself clearly pointed out in her decision that the FTC sat on things until very close to the July 18th date and their own already scheduled August 2nd administrative trial. They played delay tactics, got smashed by Judge Corley across the board, and are trying delay tactics again with the 9th.

FTC came in like a teenager trying to convince their parents to let them go to some sketchy party. Big dramatic presentation etc. and the Judge just “noped” them.

Seems like she’s a bit frustrated as well. Probably didn’t appreciate them basically saying she did her whole job so wrong it should be granted a nearly unheard of appeal.

Not necessarily, it all depends on how restrictive the cloud rights are. If it’s similar to the 10-year deal given to Nvidia, this would allow streaming of PC Game Pass, as well as individually purchased titles through Steam, Microsoft Store, etc.

It’s the sort of petty shit I’d want to do to someone as well. I imagine though that being prompt on her part makes it more likely her colleagues will uphold her decision.

She obviously didn’t appreciate the FTC delaying, I imagine it’s just a matter of professional courtesy.

Which is why I’m glad I work in agribusiness. We have zero standards. We once got pulled into a trial in NY and our emails were up for discovery/discussion. A coworker of mine had to explain to this big shot lawyer on the stand that no he wasn’t offended when a colleague called him a shit stain in a work email because that’s just how we talk to each other.

Which is why I don’t think the 9th circuit will. Judges will be able to see right through what the FTC is trying to do and the FTC can continue with their own trial.

Plus the matter has been ruled by the courts, so the FTC has a much higher of standard to clear this time rather than the original emergency TRO.
