Woah, that’s interesting!

Not like they had all those meetings for shits and giggles over there. No idea why people are so surprised. It’s been weird to see people lock themselves into one train of thought so seriously that they figured Microsoft was going to pursue an expensive legal fight with the FTC when there was absolutely no way the CMA could have their position changed.

So essentially hoping the 9th district court doesnt get confused and does something stupid (if) they get to this tommorow.

Feels impossible to me they will even look at it, but what the hell do I know.

Did they report on the death threats Corley was getting earlier?

I’m being facetious of course.

Still, it would be fun to see some of the Sony fanboy coddled entitlement run straight into the realities of what the FBI could do with a death threat made to a federal judge if someone made a deal of it.

Gaming rights, so Xcloud would still be there but Microsoft would have to pay the 3rd party company to allow people to stream the game pass games through Xcloud?

Any impartial judge should look at this and not offer an emergency stay, and that is what I expect to happen.

But just for probability sake there are 28 active judges on the 9th circuit, with 13 republican appointed and 15 democrat appointees. With that, there is a decent chance that 2 republican appointees could be randomly selected basically ending the emergency relief chances there. But it’s slightly more likely one republican appointee will be selected and two democrat appointees. That leaves just one democrat appointee to be swayed which I feel give Microsoft good chances.

I don’t think the parties are really worried about the appeal at all considering ATVI is taking themselves off the NASDAQ 100, old CoDs are being fixed, that suspiciously timed Diablo game pass ad, and the Major Nelson working on projects in the coming days tweet etc.

Judge Corley was a Biden appointee that thrashed the FTC in her ruling. I think that the FTC case is so pathetic and ignoring of reality that political party of judges may not matter much with this particular case.

I figure that with something like this political parties won’t matter, but I think it just adds a little more certainty to the decision if two judges on the panel end up being republican appointees

I dont think political party is relevant here, no federal judge regardless of party is going to look at the FTC case and not tell them to go pound sand

There might be a chance that the appellate judges extend the TRO to Saturday or Sunday night while they work the weekends to decide on the appeal. Doesn’t really affect the merger deadline at all.
