Nintendo has filed a patent infringement lawsuit on Pocket Pair

Nintendo, together with The Pokemon Company, filed a patent infringement lawsuit in Tokyo District Court against Pocketpair on September 18 seeking an infringement and compensation for damages on the grounds that the Pocketpair-developed Palworld infringes multiple patent rights, the company announced.

Nintendo did not specify which patent rights Palworld infringes, but said that it will continue to take necessary actions against the infringement of its intellectual property rights to protect the properties it has established over the years.

Nintendo and Pokémon’s full statement reads as follows:

Nintendo Co., Ltd. (HQ: Kyoto, Minami-ku, Japan; Representative Director and President: Shuntaro Furukawa, “Nintendo” hereafter), together with The Pokémon Company, filed a patent infringement lawsuit in the Tokyo District Court against Pocketpair, Inc. (HQ: 2-10-2 Higashigotanda, Shinagawa-ku, Tokyo, “Defendant” hereafter) on September 18, 2024.

This lawsuit seeks an injunction against infringement and compensation for damages on the grounds that Palworld, a game developed and released by the Defendant, infringes multiple patent rights.

Nintendo will continue to take necessary actions against any infringement of its intellectual property rights including the Nintendo brand itself, to protect the intellectual properties it has worked hard to establish over the years.

Nintendo is showing their ass!

But I doubt Nintendo can wins this, as there have been multiple Pokémon clones and they didn’t do anything about them before. Then again they’re filing it in Japan, so I do wonder if at best the only thing they could do is have it be banned in Japan.

From the screenshots that’s a one to one copy of Pokémon, so I’m hoping Palworld not doing that will be enough.

Some of the designs I’ve seen really looked a lot like Pokemon, but is that reason to sue?

That game is way too much of a rip-off that I too would sue. It’s far too deep to ignore plagiarism. Here, this can pass as parody/satire of Pokemon. Granted, it is said that the lawsuit is vague and different from the recently completed lawsuit, so we’ll have to wait and see.

Timing or not, pretty dirtbag move to do so before TGS in which Pocket Pair will be attending. It has that Sing meme where the imprisoned father watches his son succeed in singing.

I bet Pocket Pair planned to announce the Playstation edition, and launching v1 of the game at TGS. They could still do so, but it will be cloaked in the uncertainty of the lawsuit.

Has someone who doesn’t play Pokémon and has not played Palworld, from my completely ignorant perspective I never saw Palworld as a rip off. I saw the art style as generic anime inspired art. It reminded me of some of the Final Fantasy stuff.

I always saw Pokémon as a few human characters with a few of these monsters (which I didn’t see any rip off of in Palworld) like Pikachu.

But when I saw some direct comparisons I saw, to me, clear instances of ripping off stuff that go a bit beyond simply being inspired.

If those instances led to the appeal of the game and contributed to the game’s attention, then I definitely see where Nintendo is coming from in doing this.

It’s important to remember that this is patent lawsuit and not copyright. They may be suing over mechanic of catching creatures with round capture devices. And they didn’t go after Nexomon, Coromon or Cassette Beasts because they don’t use round capture devices.

I think PocketPair should be working towards invalidating the patents with the patent office. Though I havent seen specific patents specified by Nintendo, only seen folks searching for patents on their own.

Yep or if it’s simply the PokeBall thing, change the game to use nets that capture then shrink the Pals so they can be put in your backpack - and other stuff like that.

So even if the patents couldn’t be invalidated, they can probably work around them (although probably have to pay a bit to Nintendo for the usage until now).

Even if the Japanese establishment may be slightly pro-Nintendo, there’s no way this game is getting killed
