Didn’t MS put a carve out ‘nuclear’ option in the latest contract?

Think that referred to the divestiture remedy. Carving out ABK if that was even practical or possible wouldn’t remove the CMA prohibition so would still be a messy process. Years of legal fighting.

Sorry I didn’t listen to the court case. I do remember people saying though, that the gist was CMA walking back on a lot of things they said and trying to basically take back their blocking of the deal, and the judge was telling them it doesn’t work like that. I even remember the judge saying this deal is going through, how did we get from that, to waiting to see how CMA will try to block again?

We aren’t saying that. We all expect the cma and MS to find a mutually agreeable position that allows the CMA the legal headroom to change their final order.

But in the very unlikely event that can’t be achieved we are discussing what might happen. This is the 2% chance.

Every time someone here posts some ‘concerns’ i just look at ATVI stock. And the only noticeable movement i see there is because of the dividend payment of 0.99$. Sooo :woman_shrugging:

People are just being impatient and think just because we don’t get to see much movement on it for the time being that something bad is going to happen or MS need to DO something. Thats not how these things work.

Which would be why removed it maybe? Because if they’re accusing Microsoft of buying favors to get it done. I think Microsoft would reach out to them and make it clear they’re making false statements that could lead to litigation.

At least that’s my thought process.

All quiet on the ABK acquisition front I see.

Correct me if I’m wrong but wasn’t this coming week (7th Aug) the week the CMA was aiming to release the provisional findings again?

I believe so. Things will start to escalate and that date may be the starting point.

Yes I agree. I suspect we will get the NZ decision this week, and then perhaps some sort of document release from the CMA, whether that’s the submissions of third parties/Microsoft’s new RMS proposal

Of course would love a announcement his week saying they’ve approved

The following weeks are the returning of the rollercoaster we had in July which was ,in my opinion, the most fun I had in gaming this year. Here’s what I think will happen with the CMA:

I think they will still say no the the, lets call it, “concessions path” but will accept the “the divesture path” and that’s why MS gave themselves until mid October in case they have to work a little longer and then close by mid Sep-early Oct.

Of course I hope with my all heart to be wrong and for the deal to close at most in the weeks the CMA set the deadline but you never know. What do you think guys?

Forgive me i am not fully caught up. Just to be clear is the divesture xbox has to give up cloud gaming in the UK or fully divest the CoD IP? Or something else?

No one outside of MS/ABK/CMA/CAT/3rd party involved knows that. Its been confidential events so far.

Many suspect that it is only license to cloud gaming rights of ABK titles.

The supposed cloud divesture. MS outright told them in their last submission that they are not divesting any part of ABK just to “appease” their absurd and minuscule cloud concern.

I remember Hoeg said in one of his podcast that it was probably MS the one who “leaked” the divesture part to start controlling the situation.
