So if CAT ruled in MS favor could the CMA still use cloud reason to blocked the deal again or no?

If the CAT does not remit to CMA, then the CMA will have to appeal to Court of Appeals.

In this very unlikely hypothetical scenario, Amazon (Luna) or Google would not be allowed to acquire Xbox based on today’s CMA ruling imo.

You are thinking of rules applying to Microsoft and Xbox only, common mistake.

These are the same people that got mad at Microsoft when they had 3rd party exclusive games like Tomb Raider or bought Zenimax and were shocked Xbox was making Starfield and ES6 exclusive.

In my eyes this is over. The deal is blocked.

I’ve been following this deal almost obsessively the past year and knowing there is a (futile) attempt to still make the deal happen, even thought literally everybody has said the CMA appeal process routes back to the CMA… Its over.

I can’t follow this any longer, it’s not healthy, over a year of my life checking for news daily and it might go another couple years ? No thanks.

Time to be excited and look forward to what Xbox actually has…Starfield and Redfall come to mind, and hopefully a great e3 showing.

Time to stop listening to Xbox podcasts who just regurgitate all the info I already know giving their uneducated and unrealistic “takes”.

I don’t think they will actually end up following through with an appeal. I feel like that’s just making shareholders feel better for the time being until other agencies decide or they come to a mutual agreement to cancel the deal, etc. I do not see how the CMA will ever overturn their ruling even if the CAT approves of a review.

Very disappointed by today’s outcome. Wish this would be over with in the next month, but instead it’s possibly going to take another year+.

Okay I’ve finally caught up, today didn’t go as planned so I’m only now reading everything.

As someone who was not a fan of this deal due to the price and the return (even though I agree it is a totally logical thing to pursue and I don’t think that the price is unfair):

MS has to fight this for the good of the gaming and tech industries.

The CMA’s argument was always flimsy and factually incorrect. When that was pointed out they changed their argument to another flimsy and factually incorrect argument as the basis for rejecting the deal.

As such, this makes any tech merger or acquisition impossible to pursue. When every single pundit an expert thought that the deal should go through, and then we end up with a situation where the CMA makes an irrational (I’m not just using the term in a legal context) decision and prevents it, how is any tech company going to pursue a merger or acquisition going forward?

The answer lies in every M&A being under a dollar value threshold that makes it invisible to any scrutiny.

But is that how tech wants to operate, going forward?

As such, I do think this is where MS needs to consider buying both Capcom and SEGA. The time to address the Japanese market is now.

They should appeal this, but will likely lose the appeal, and then partner with Activision in making their games exclusive as gaming media pundits suggest.

Sometimes you have to learn the rules of the game the hard way. Sometimes you have to learn, the hard way, that the refs are biased.

They will because this will ultimately effect future acquisitions, they have to fight it

The CMA had better be looking at Sony because of all their unhealthy things, because Sony Is hurting the video game industry.

Getting a CDPR for example would definitely move the needle and in a few cases, be a far bigger and better acquisition than some publishers out there.
