The thing is, it would be pointless of the judge to say sheâd try to get in done in time for 18th (so by today at the latest), if she didnât think she could in time. If she felt she needed a couple more days, she should also notify the parties/public to that effect as well.
Since it could potentially be the last week, what do you think Microsoftâs strategy would be if the deal does go through?

Put Diablo IV, Tony Hawk pro skater etc on game pass in the next few months (no cod till end of 2024 or 205 due to contractual obligations with Sony) if the deal goes through. If it doesnât go through, nothing. You will see Microsofts acquisitions be silent for the next few years most likely.

Thursday might as well be never, based on the fact itâs going to cost MS billions of dollars for the sake of the judge being able to have a nice, relaxing weekend.

There is a 5 day period normally following a decision to allow for appeal. During that period MS canât close. However the judge in theory could shorten that period if she chose. The more likely scenario is the one discussed on Twitter that whilst it will go beyond the end date that end date doesnât kill the deal if both sides simply agree to allow a few extra days. The end date passes it means one or both can walk away but if they donât want to itâs not a hard date.
The question is whether MS want to extend by months for the CAT anyway. That would render the 18th moot. But theyâd not renegotiate that until they know the PI decision.
Its also an arbitrary date in which we donât know the terminology for. As yes a 3billion dollar fee becomes payable on July 18th but we donât know what clauses exist along with that. since they are literally waiting for a judges decision does that date become a bit moot as its just waiting for legal decision? we donât really know without seeing the actual contract in full to know what was included in clauses around that date.
Have both sides extended the date already? We really know donât know. Has the judge or her staff verbally notified them prior or spoke with them via some zoom meeting? We really donât know for sure as this is a bit of a unique situation and even professionals are doing just a bit of educated guessing based on precedence but its a fluid situation.
Damn, thatâs a lot of we donât knows. Here I thought we at least had the 18th, for something to happen, haha.
