The full decision yes. But the outcome is not. According to the lawyers on Twitter. We all see the outcome at the same time according to them.
This could also be true. Forgot all about the discord as I am not on it.
Typically the public becomes aware of the outcome of a court decision when it is officially filed with the court. This filing becomes part of the public record and is usually accessible through the courtâs public docket system, such as the Public Access to Court Electronic Records (PACER) system in the U.S. federal court system.
In cases where a decision is sealed due to containing sensitive or confidential information, the fact that a decision has been made and filed is usually still a matter of public record. However, the specific contents of the decision are not immediately accessible to the public. The public would then become aware of the specific outcome when a redacted version of the decision is released or when the seal is lifted.
Theoretically, it is possible for a court to file a decision in its sealed form first and then ask the parties to propose redactions. However, this is not typically how the process works. Generally, the court will provide the decision to the parties first for them to propose redactions. Once the court has reviewed and approved the redactions, the redacted decision is then filed and the seal is lifted. The reason for this is to ensure that any sensitive or confidential information is appropriately redacted before the decision becomes part of the public record, even in its sealed form. This is because once a document is filed, it becomes part of the official court record. Even if a document is sealed, there is a possibility that the seal could be lifted or the document could be accessed due to a clerical error or other unforeseen circumstances.
In conclusion, Microsoft and ABK would know the full decision days before the public would even know a decision was even reached via PACER.
I wonder if Microsoft and ABK have a verbal deal for an extension? The deadline is pretty close and with uncertainty on the judges decision plus whether the FTC will continue to try and block if they donât get the PI.
You are misreading your own text. The decision is filed and of public record. Without the full contents.
Florian et al have explained this. Microsoft will find out same time we know. At least thatâs how it works 99% is the time. They will then have the full decision to work through the redactions process.
The only reason they would extend is for the CAT process in the UK - if MS arenât prepare to close over the CMA. If the FTC win the PI or indeed win an appeal then both parties have said under oath the deal is dead.
It would also depend on when the US federal judges ruling comes out. If itâs after Monday there wouldnât be the five days necessary to close before the deadline
I agree but everyone is working on the assumption her decision will be before then.
Im team Monday (said it earlier in the week)
- That she files it under seal means that the general public canât access it but doesnât mean it will be the best-kept secret of the United States government.
But who knows
Under seal means we know the result but not the reasoning.
Government officials and insider trading in the US. An iconic duo (also apparently not illegal either (as per otherera)
But as Florian explains the judge releases the ruling onto the electronic system and nobody is tipped off or given any advance notice. In almost all cases.
At least we know it has to be before the 18Th, thatâs correct?
In theory Monday is the latest date
We need 5 full working days for APPEAL
I havenât been following too much, so I have a question. If Microsoft wins in court does that mean the deal goes through or do they still have to wait for the CMA appeal review?
Not sure if already asked but as Monday is kinda the deadline with the 5 day cool off period. Do we know the timing of these events?
As in for MS/ABK is it close the deal by 6am, 9am midday, 6pm on the 18th?
Wonât the judge need to give them some extra time on top of the 5 day cool down. My thought is wouldnât that mean a decision early Monday is preferable or wouldnât it matter. Or am i bring way to strict about this
Not yet really known what MS will do at that point. They could close over the Uk and deal with the CAT after or they could extend the deal.
We donât know yet, many experts seem to think theyâll close over, some even think the CMA/UK will drop its case/accept remedies.
