I see they are just as flabbergasted as we are at the FTC’s refusal to just not take legally binding contracts seriously.

It is why I still think the judge herself asking Phil to swear under oath was so damaging to the FTC’s case.

Somehow, I think if Microsoft defeats the FTC here the CMA might reconsider. Microsoft is the number 2 company and their closing over the CMA will carry a lot of weight in the business world. I know the CMA could levy fines but closing over them could end their ambition to be the world’s police. I think they might just want to work something out. In all this the FTC and CMA reputation has been hit hard.

Wonder why that is. I would assume it has to do with Sony, but we didn’t hear that so far. I’m sure MS would have wanted CoD on their service. Ah well, if all goes well we could be seeing them really soon.

Unless we really won’t see any CoD until Sony’s deal is over. But surely that doesn’t cover every single CoD?

Could be part of their marketing deals?

Here we all are thinking this and wondering what the hell is going on, they’re already under remedies in the EU so it’s not like they have zero contracts right now. I bet you the Judge will ask Nadella to swear under oath and if that does happen it’s probably the last nail in the case, if nothing else comes up against the deal.

That would be;

  1. The head of the gaming division under oath
  2. The head of Microsoft under oath
  3. Contracts with Nintendo
  4. Contracts with 6 cloud companies
  5. Approval in like 40 countries or a handful of world regulators.
  6. Worldwide remedies provided by the EU

Not quite sure what else they can do.

And it’s not like the EU is afraid to take big corporations to court, so as you say it has gone one better and the contracts have been submitted to a regulator and is now enforceable by them.

That is actually a good point and I can see that happening since technically it is harder to replace Satya than Phil so his pledge will only carry more weight.

You mean the good old game pass blocking deals? That’s certainly a possibility. PS + now having had several Cods, you’d think Xbox could have some too.

Thats the thing with ideologues, there is nothing you can really do but to defeat them in court. Even if the FTC lose this case i don’t even think they feel defeated.

I think its highly unlikely the CMA will budge now. They have the jurisdiction here not to have to. Challenges to them aren’t the same as to the FTC. They don’t have to win on merits simply on their legal status and that they maintained procedure. Which means they hold the cards.

They would rather deal with MS closing over them than having to back down now. They’ve painted themselves into a corner but have missed all the exit points.

I genuinely felt quite embarrassed (and sorry) for him yesterday. I’m surprised his ‘research’ managed to get this far without being scrutinised further.

So Playstation wanted all Activision games + marketing rights for Cod + PS Plus or no Gamepass release + all Bethesda games and when Xbox didn’t accept they cried about anticompetitiveness? What an absolutely joke and waste of time!
