More days and hearing time is better for MS, if MS has an 80% chance of success now they want to turn that into a 95% chance
The funny thing is, this was always going to happen. Even if the CMA cleared the deal unconditionally, a Lina Khan led FTC was going to proceed. It’s what she does.
What should be a shock, is that the FTC felt it necessary to go with a PI now. It’s clear that the FTC believes that MS & ABK will close the deal soon.
I think that Judge Corley is off this week and part of next lol. Do they call people in for this stuff or does it get post poned or even reassigned (lol)?
This is why i disgaree strongly that MS would continue if the FTC won the PI. I am curious if that happened if MS can take it to an appeal court and appeal the judge decision
We know if the FTC loses (which is the very likely outcome) theyre going to try to appeal
The real question is if the FTC appeals would that force MS and ABK to delay closing
Its nice impossible to break companies up, so if the FTC cant stop closing even with an appeal then its pointless to appeal
But who knows. No doubt MS and Activision considered the FTC appealing, they have to know something more

If the TRO is lifted though then they can close, even pending appeal. The FTC would need to get a TRO extension from the judge that denied the PI if I understand correctly which is unlikely.
If MS had to appeal a PI I wonder how long that would take, but i dont think MS woud bother so ce it would weaken their chances against the CMA

I was reading Koticks letter and he saidnthat theyve been preparing fir over a year for this, I just cant see any realistic way the FTC whi are ill prepared and incompetent can get a PI

Okay, well, Microsoft now has the deal in the most faborable position it has in a long time. This is the position they wanted. They have their day in court with their high powered lawyers up to bat. If they lose, they lose in what they viewed as their strongest position.
People are nervous cause its all on the line, but ironically this is probably the best Microsoft and ABK have been feeling since the FTC and CMA moved against them.

Was speaking to someone on another forum and he said that the motion to appeal wouldn’t come from Judge Corley, but the FTC have 5 days to file a motion to appeal and they have to get it from an appellate judge
But no appellate judge is going to grant the FTC a motion to appeal after a failed injunction let alone in 5 days
If the FTC lose the PI its really over for them as far as this deal goes, they’re out of the picture
