Amazes me that the CMA asked for more time with a straight face when they wasted no time in calling out the EU.
Also might be a good idea to not respond to a 6 page document from Microsoft with a 500 page response of case law, seems like theyâre stalling.
From what I have read it does seem like they are stalling, which, if you come out so certain of your decision after over a year of invesitgation, you should have your counter points at the ready if you had complete confidence in your decision.
Case law and legal precedent is their defence. I donât think thatâs necessarily an issue. Their obvious delay tactics though point to collusion. I get that the expedited timetable is not usual but they should not have an issue with it given their defence of this isnât novel. Itâs much harder for MS than the CMA . Yet the CMA are the ones crying for more time.

It would be wondeful to get the Canada and New Zealand decisions the CMA tried to use as stall tactics before the 2nd case management hearing.
This was just like that good cop bad cop approach. Microsoftâs lawyers were to the point and the Activision lawyers were lashing out with fury. I do wonder if the hearing is only expected to be 6 to 10 days does Microsoft still need to renegotiate or extend the closing date or is there a grace period added.
I dont think decisions are made in trial, are they? I thought a decision would be post trial and aiming for before September.
Edit *After reviewing the previous M&A cases before CAT, it looks like their previous quickest decision after an appeal was 4 weeks. Im guessing the expedited case will receieve an expedited decision that will aet a new peecedent, but I wouldnt count on somwthing that week or anything. I would suggest that it seems like it would come before September.
Iâm guessing MS and ABK will have to negotiate an extension to their deal considering the outcome of today; wonder what will come out of it. With how hard they are pushing Iâm guessing itâs in both partiesâ interest to keep this deal alive and keep moving forward.
Hopefully after today the CMA comes to reasoning and unblock this deal. This whole speedy trial seemed like it was geared to avoid renegotiating. Even the judge urged them realizing the size and global impact of the deal which the CMA seemed oblivious to and treated like a common thing.

Best to check the CAT website to see if there will be an upload. This was probably their most viewed stream. Maybe Destin will try to get something since heâs content revolves around this. It certainly was fun watching. The Microsoft and ABK lawyers totally dominated.
