Ms is dropping man hours and a ton of money into this deal. And it really feels like theyāve put all their chips into this one large single basket, itās hard to argue that this doesnāt affect how they themselves treat the Xbox brand.
If this goes on into 2024 their last acquisition will continue to be Bethesda which was made in 2021.
Iād even argue them focusing on this deal played a huge part in their very lackluster 2022, trying to look small and weak for a deal to go through is smart, only until the deal fails and youāre left looking small and weak to the average consumer for 2 years straight with nothing to show for it.
For everyone thinking an appeal will succeed see this. Looks less likely now. Which may be s good thing because they can target other studios and deals.

Xbox future is doom and gloom after every negative news. It doesnāt matter if itās something big like the ABK deal or something small like missing out on Final Fantasy Pixel Collection.

Meta appealed over Giphy and CAT overruled CMA off procedural errors, this let the CMA redo their review but use the same argument
The CMA cloud argument would likely get tossed out due to irrationality which means the CMA wouldnt be able to use that argument again
Honestly, I think the odds of CTA going against the CMA are bigger than these were for the CMA dropping the console concern after Phase 2.

Irrationality is less likely to win than procedural issues. Thatās the point. Itās a higher burden of proof. Far higher.
