I thought the CoD thing was getting access to content a month early. Other than Rise of the Tomb Raider I don’t remember hearing Microsoft making super long Exclusivity deals.

2 Gens ago? I dunno how you could be so indignant and so wrong. MS had exclusivity on large AAA games just a generation ago… Titanfall, Sunset Overdrive and Tomb Raider come to mind. It’s an industry standard thing to do… So why are Sony so scared to show the details of their dealings since “everyone does it anyway?”

Microsoft was the market leader? They’ve never outsold Playstation during any generation.

Exclusivity in and of itself is not a big deal. What is an anti-trust violation is when an entity that holds a monopoly in marketplace (70% or more) abuses its marketshare to get terms that exclude competitors. Things like the clauses Playstation is using that prevent games from going to gamepass are an example.

Perhaps not once all sold units are tallied at the very end of the gen, but for a long stretch of the 360 generation they were indeed outselling the PS3.

They definitely outsold PS3 with the 360s first year on market…

This really doesn’t even make sense, no one is saying exclusives are bad, it was about the fear of a court exposing contradicting business practices that run against a plaintiff’s stance on why something should be considered harmful when engaging in the same practice (honestly worse, let’s be real).

Then you went off on a tangent about how MS wouldn’t produce documents in a theoretical scenario 15 years ago? I honestly don’t understand what you are you trying to say. Yo would think Sony would be willing to back the FTC here, instead of leaving them out to dry…

In the US, the acquirer doesn’t need to prove anything as acquisitions go through by default and can be potentially blocked by the DOJ or the FTC. As it’s Sony who cried foul to regulators about theories of harm behind this acquisition, it would behoove them to back them up with actual data, which they’re clearly not willing to share.

A couple things:

  • Xbox definitely never had a monopoly share of the market.
  • The market then most certainly included Nintendo as there was a high correlation of games and the power capabilities were similar.

I think the 360 being out first and costing less helped in that regard.

The Tomb Raider deal was definitely not ideal, but I do remember no one wanted to publish Sunset without claiming ownership of the IP except Xbox. I didn’t delve to deep into the rest of the information so I don’t know how much Microsoft paid for the games development. I think it could be the same with Titanfall as Microsoft only seems to own the publishing rights of the first game not the IP.

Sony complained about the deal and need to provide data to support their claims. It is a trial, Sony should have known that it cant be sustainded because “I said so”. MS asked for data, judge granted and Sony needs to provide, simple as that. Whether or not MS would provide docs 15 ys ago is irrelevant, laughable and completely speculative as well the fake paralel with showing console sales number.

Tomb Raider deal was perfectly fine at the time imo, just entitled PS gamers crying about it. Crystal Dynamics did say MS was helping with development at the time though… Isn’t that… Oh yes, exactly what the devs if FFXVI are saying Sony is doing! Weird how at the time it wasn’t true but now that it’s for PS5 poor Square Enix can’t develop a game on their own. Without some help.

Titanfall I believe was going to get canned by EA or something to that effect and MS came in to save the game and so got exclusivity and marketing on the first game but as you said they don’t own it.

Sunset Overdrive I’ve heard the same story as you. Does make a lot of sense Insominiac were bought by Sony in the end and for so cheap; Sony already owned all their successful IPs!

Perhaps releasing 1 year ahead of your competitor means you are a “market leader” by default since you are basically the only one on the market. Sony still ate their lunch with a disastrous launch and more expensive console. Really says everything to be honest. And tithout the huge USA sales that gen Xbox 360 didn’t do all that great worldwide compared to PS3.

Xbox 360 sold 100.6 million units compared to the PS3s 87.4 million. A gap of 13.2 million.

People forget the 360 was outselling the PS3 3:1 since 2013.

As someone who followed the numbers all generation long, the PS3 definitely didnt “catch up”. Its a myth propagated by Playstation fans to hide PS3s failure.

In fact Phil himself called Xbox 360 the global market leader when the Xbox One was revealed

“I think, coming out of this generation, being the market leader globally and really differentiating with online and that community, our third parties have been pretty eager to partner with us and I think you’ll see between the 21st and what we do at E3, I think you’ll see some really special and unique things,”*

Obv. figures for this kind of stuff are not going to be floating around publicly but insomniac did confirm that MS funded the game development (fully) and provided “resources” for development.

Don’t think this is right. All the available info shows that EA went Xbox exclusive as they felt that an Xbox and PC user base would give them the most sales based on historical 360 and PC data (oops).

All this past exclusive talk regarding Xbox is meaningless because Xbox/MS wasn’t trying to kill any gaming acquisition back then. Why do some of you feel the need to hold water for Sony and and “cry MS did it too!” While being flat out wrong or not providing context?

buddy microsoft funded sunset overdrive not timed exclusivity thing tomb raider thing was for a year and then it came to PS same cant be said for sony when they have exclusive multiplayer modes or exclusive quest like in hogwarts and some games like final fantasy which we dont even know if it ever comes to xbox so there is difference buddy
