Just as everybody thought, FTC doesn’t want to bring it to Federal court and are just posturing. They know very well how fast they’ll be shot down if it reached the Feds. Microsoft also assured that they have zero plans to back down.

I think as soon as CMA releases their statement it is gonna be a wrap for FTC.

The FTC has no case and it’s just trying to run out the clock on the deal so Microsoft and ABK abandon it, what a clown show the FTC is, let’s hope CMA and EU have no more issues so the FTC gets a well deserved lost.

If the CMA and EC approve the deal, I believe that the FTC would have to move for an injunction in federal court to block the deal. In order to move for an injunction, a vote is required by the commissioners to move forward with attempting to obtain an injunction to prevent the deal closing.

I wonder what level of support there would be from the third democrat to go obtain a federal injunction. That point was where the FTC ran into a 2-2 girdlock regarding Amazon-MGM. It could also be why things have played out without the federal injunction so far.

It is very normal for the commission to vote on the administrative process and obtain a federal injunction at the same time. Could the noise we heard around the 3rd democratic comissioner have been because she did not support going to federal court and obtaining an injunction?

Like many have said it’s just posturing but their bluff has been called out. Destin got in on the call and said the FTC lawyers sounded nervous.

I am pretty sure that FTC is aware that they have no legal ground on this. They hope for other regulators to block it but if it won’t happen FTC will live on a borrowed time. Especially with SC coming after them.

Beth Wilkinson (Microsofts high profile attorney for this case) was on CNN and said she told the ALJ that Microsoft will close the ABK deal if the other pending jurisdictions approve. Sorry, I don’t know how to clip tv segments or I would do that.

So basically if the CMA and EC approve, while the FTC is still dealing with it, they will close it.

Idk if pending jurisdictions includes any others like SAMR or the smaller ones that keep delaying. My guess would be CMA, EC, and SAMR.

Fair dos. If the FTC is gonna drag out a case MS is entitled to expodite its closure.

Nice. It also goes to show how (rightfully) Microsoft trusts its cause.
