The green light from the Federal Trade Commission for Microsoft’s acquisition of Activision Blizzard could come next month. A few hours ago the Redmond giant confirmed that it had responded to the second request for sending documentation by the FTC and now the US government agency has 30 days to request further information, otherwise it will have to automatically approve the operation.

Uhmm didnt the original source said that they already entered that stage ā€œseveral weeks agoā€? So if I’m understand it things correctly we could be waiting for just a couple of weeks to see something from it (again, if I’m understand it correctly :p) Even then, this part is not true:

Consequently, the agreement between Microsoft and Activision Blizzard could materialize as early as August.`

We know we have to wait until September to hear what UK’s cma ā€œthinksā€ about the deal. We may be nearing the end of the ā€œUS FTC chapterā€ though. Hope to ear something soon from EU.

Things are moving pretty fast, specially compared to the expected date which MS gave us (end of fiscal 2023)

I think there will be more to this deal then just approval from the government institutions

The shear amount of money involved and large amount of IPs and HR documentation would take its own time to get finalised

Still expecting Nov closure date but August is too quick

Microsoft provided the timeframe between July 2022 and July 2023. I am not sure why people think (a lot of them) that the deal suppose to close at the end of 2023 fiscal year.

Everyone talks about Blizzard for PC Gamepass and that will be a big deal. However I think everyone is sleeping on how much of the Serria Games will play a big part in expanding that catalog.

I’d go as far as too say that Serria as a brand should be revived too focus on point and click adventure games and narrative games not unlike life is strange, as dusk falls, and The Quarry.

Wether it’s older Serria IP like King’s Quest , new IP, or using other ABK or MS Gaming IP.

Oh yes you are totally right my friend! Was doing some investigation (:nerd_face: ) and found the following in their official website:

Step Four: Parties Substantially Comply with the Second Requests

Typically, once both companies have substantially complied with the Second Request, the agency has an additional 30 days to review the materials and take action, if necessary. (In the case of a cash tender offer or bankruptcy, the agency has 10 days to complete its review and the time begins to run as soon as the buyer has substantially complied.) The length of time for this phase of review may be extended by agreement between the parties and the government in an effort to resolve any remaining issues without litigation.

Step Five: The Waiting Period Expires or the Agency Challenges the Deal

The potential outcomes at this stage are:

  1. close the investigation and let the deal go forward unchallenged;
  2. enter into a negotiated consent agreement with the companies that includes provisions that will restore competition; or
  3. seek to stop the entire transaction by filing for a preliminary injunction in federal court pending an administrative trial on the merits.

Unless the agency takes some action that results in a court order stopping the merger, the parties can close their deal at the end of the waiting period.

As @hexbacon noted, in the original article of Seaking Alpha’s source it is stated that MS already submitted the info a several weeks ago, which could mean the already entered phase 4 well…several weeks ago (:V) and it could just be a matter of a couple of weeks more to see/hear from the FTC (if I’m understanding things correctly)

Microsoft ([MSFT] certified substantial compliance with the FTC in regards to ATVI several weeks ago, according to a Dealreporter item, which cited sources familiar.

One thing to add is that the FTC doesn’t publicly disclose cases. There won’t be a link to a document stating the reason why the FTC didn’t dispute this transaction. Instead we will more likely get one of the parties involved mention that FTC didn’t asked or dispute the transaction.

Any headline to any article stating that the ā€œFTC Approved MS-ATVIā€ deal is wrong and misinformation. We will for sure get a public notification from the EU and maybe other regulatory bodies across the globe.

Oh! No wonder there was no document after Bethesda deal. Well, then we will only be able to read EU conclusion.
