Do you have any links to the florian stuff? I deleted my twitter account the day musk bought it and wont make another one, now I cant look at twitter for the most part.

I scrolled back a few hundred posts just in case I missed it in here. Saw a few florian tweets, but none addressing that specifically.

There isn’t a ton that can be done about dates when numerous parties and processes are involved. You obviously push to meet your own, but there is no guarantee that everything se falls in line.

They’ll close on time if they can and they’ll delay if they need to. I dont think there’s much more to it than that.

Thats fair.

I feel like trusting the CMA is a mistake, and I bet the FTC uses the opportunity to try and block again if the deadline is extended.

Thats simply not true unless the time is considerably less than the 6 weeks being tossed around. The extension would need to be limited to a maximum of 3 weeks in order for the FTC to be unable to further mess with the process.

The in house trial and the appeal are both within the discussed 6 week time frame.

Honestly, I don’t even know why closing over the CMA even became such a popular narrative.

Also the ALJ recommendation is just that a recommendation after the FTC changed it and with the FTC vs Axon Supreme Court decision even if they rule against it will now be able to be tried in a Federal Court system instead of the inhouse trial so if they want to keep losing they can go a head

then MS wouldn’t have agreed to it if they didn’t find a way since it was a joint agreement to suspend it and they MS know more than we do

I mean, the best outcome at this point would be for the FTC to just drop it and none of this extra discourse will matter anymore. They have to know that they aren’t going to win long term and MS isn’t a company that you can hurt by drawing it out, they have the resources to take it the distance and not feel it at all.

it was just seen as like the nuclear option to try to get the CMA to the table or to really do it as a last resort type thing

Well ill take my L, i was sure about Saturday closing yet lo and behold

Still too many conflicting opinions

Foss and Hoeg believe the deal will close in a few days

Tom Warren believes they’ll extend few weeks

There is that UK attorney Luke Steele who says he doesn’t know but that its likely MS wouldn’t close over the CMA because it’d be operating in bad faith and MS would rather try to work something out

My opinion is that if it does still close before the 18th than MS and the CMA have come to an agreement or at least allow MS to close everywhere outside the UK while they work on a structural remedy in the UK

The FTC lacks common sense and I wouldn’t be surprised if they try more shenanigans before Microsoft and the CMA come to an agreement.

The trial starts on August 2nd. It will take a while and then the decision is usually months away. Certainly won’t be in the 6 week window regardless.

I don’t think it’s even possible from a legal or structural standpoint to close ‘everywhere but the U.K.’ I mean maybe it is but surely you’d have to give all ABK UK and trading operations that run through the U.K. separate legal and trading status establish a board and a governance structure etc….which is different to exciting subsidiaries that are not necessarily holding all UK ABK assets and aren’t individual trading entities.

And doing that would take a not inconsiderable amount of time and effort. And how can you stop for example that UK independent ABK being bought by someone else in the meantime?

That would be best, because like others here said, who’s to say FTC won’t try some bullshit again? This shit just needs to get over with already, goddamn. The Zenimax acquisition surely went smoother, I mean understandable, but enough already.
