This appeal/TRO/whatever it’s called has to have a decision made by Friday night otherwise MS can do what they want right? i.e. close the deal

So if their TRO gets submitted how long does MS get to make a response? If they don’t give MS enough time, couldn’t MS just run out the clock and say “oh well, too bad, should have submitted sooner”?

But even if they do give MS enough time to submit a response, wouldn’t the new judges need enough time to be able to go over both responses? That seems like way too much work to get done in 48 hours

I’ve asked the question multiple times and have yet to get an answer. I used Canada for my example. If Canada blocked the deal, do people seriously think Microsoft would be ‘damn, guess the deal is dead’? Microsoft would close over Canada in a heartbeat, and I say that as a Canadian.

Fuck no. Microsoft would withhold all ABK games (including the Playstation versions) and tell angry gamers, blame your government.

The difference is MS would just pull out of NZ and wouldn’t need to break the law. NZ would then back down.

However the U.K. is too significant a market for MS to do the same and also far too connected to other major markets.

I’m not suggesting they won’t close over the CMA. Simply that it’s not a simple financial calculation. There is more to it.

Why wouldn’t they close over the FTC and a TRO? Is the same question.

The FTC itself is the real immediate harm to the public… well, to the pockets of the public to be more precise.

OK fair enough, and Canada? A pull out of Canada would result in the closure/relocation of the following studios/talent.

  • Alpha Dog Games
  • Beenox
  • The Coalition
  • Compulsion Games
  • Radical Entertainment

This list doesn’t even include support studios or other locations that Microsoft may have in gaming and beyond.

Canadian regulars delayed for so long that they no longer can try to stop it. MS is free to close over them at anytime.

I know, but I’m using Canada as a hypothetical here. My question is, had Canada blocked the deal, would we seriously question whether or not Microsoft would close over them?

Interesting that there seems to be suggestion that the FTC appeal has a chance at winning a stay.

This is just never ending. 2039 and we will still be here discussing whether MS can buy ABK.

Even Florian sounds more uncertain than usual. Small chance. But the FTC arguments could confuse the appeals court enough for them to err on side of caution and issue a stay.

His happiness is going to be the 9th wonder of world at this point.
