Why do you believe the comity portion of the argument will stand at CAT? CAT has yet to hear a case with a significant number of countries ruling on it and it is part of CATs review capacity under two aspects: rationality and proportionality.

I would consider this yet another of the items that is unique to this case and will be precedent setting.

The comity part brings in the global scene asks why one country would try to be police for other nations that have approved. I’m just guessing here since Microsoft included it and I did recall in one of their replies to the CMA in phase 2 had warned and told the CMA they can’t hold other nations hostage. If the judge considers it which I would hope since this is a global merger, then it should stand. You are right this is unique and would be precedent setting.

Eh, I don’t think it’s quite so black and white. On the surface it may seem like that, but let’s not pretend that the US doesn’t control a disproportionate amount of the global tech market.

I’m really of two minds on this whole thing. I want the deal to go through and I don’t think it really contributes much in a meaningful way to ā€˜Big Tech is too big’. That said, I do completely agree with the statement that ā€˜Big tech is too big’. I do believe it’s true and really worry about the future if something isn’t done to help the smaller countries and firms. It’s essentially impossible to compete at scale and the best you can hope for is to limp along on VC money until one of the big guys gobbles you up.

Microsoft seems in a hurry, closing before the next renegotiation seems a fools errand under any given scenario currently

CMA basically wants to delay the deal as long as possible, even if they lose , like the FTC. If they get a delay it’ll be till the fall. They also want to have as little argument as possible as they fail on basically every point of fact

Looks like Microsoft can close in Canada in the current state, CMA are trying to bank on FTC and saying there is no rush because FTC/Canada and Australia haven’t ruled.

Microsoft said that the FTC hasn’t attempted to block and the waiting period is over so they can close. :sweat_smile:

which is 100% true. In point of fact, the FTC hasn’t actually done anything that would stop MS from closing. The reason being that they know they’d get destroyed in court
