MS and Activision not waiting for FTC and closing the deal by June would be such a Chad move, lol. However, it would be expensive as hell if FTC sued them in federal court and actually won, however slim its chances appear to be at this point in time. So I think it’s simply posturing on Microsoft’s part.

I’m a 35yo from Poland, I blindly use expressions I see on the interwebz. :face_with_peeking_eye:But I don’t think any of Jim Ryan’s actions would qualify as a Chad move.

It would never happen, but I’d love to see a game of chicken where MS was like ā€œnah we’re just pulling all our products from the US, good luckā€.

It definitely seems MS is all in for the deal, but if it goes past the cut off date, do ABK shareholders need to vote again to continue with the deal ?

Makes you wonder what would happen if a majority of shareholders no longer want the deal to go ahead, after the success of say cod and diablo 4

Shareholders won’t vote no with such upside if it goes through and facing a down market and recession if not.

MS said on Monday that the deal was undergoing review over in Europe and the UK and that ā€œWe are hoping that they will be resolved and if there are remedies that are appropriate we can come back to the FTC to talk about a resolutionā€.*

The FTC responds that they are always open to any remedy or settlement proposal either in litigation or before litigation, although ā€œThere are no substantive conversations happening at this timeā€.

The same day, MS and ABK, amend their responses to drop the anticonstitutional arguments (arguments that were there for a specific reason, the MLex report from today is proof enough).

And today the CMA delays the whole process two months.

I don’t know, but it feels like too many coincidences at the same time… :thinking:

Sounds like there are negotiation talks happening or starting to happen, which expidites things.

Everyone knows the FTC has no chance if this goes to Federal court but that would easily delay the acquisition until 2024+ due to timetables and scheduling, as well as delays which seemingly happen all the time. Still, if Microsoft can expidite this without taking risks and close this year like they want, it’s a win for everyone.

So was that all a scare tactic and now they are like, so how about peace?

I guess FTC was concerned that MSFT would push anticonstitutional angle and Microsoft is an entirely different beast in USA government

Nobody knows yet, but the FTC can claim a media win or spin one going this route (ā€œwe got MS to do this even though they proposed it anyway and we didn’t even hear them outā€) while not getting yet another expensive loss in court that ultimately is paid with taxpayer money. Khan already asked for more money a while back and was laughed away due to her wasting millions on ā€œpersonal agendas.ā€

The CMA extending for 2 months means that they don’t view the arguments in Phase 1 as substantive enough to block the deal, as is mostly seen as positive for Microsoft.

I suspect Microsoft knows things we yet don’t but all we can do is wait and see.
