Microsoft’s stance towards CMA is that CMA provided bunch of nonsense so I don’t think Microsoft will offer any more concessions.
If FTC and the EU both approve it without any/major concessions, I wonder, do MS just give the CMA whatever they want to get the deal done? If it only applies to the UK does MS really give a toss?
Sure they’d like to have zero concessions everywhere but if these things only apply to the UK market, are they really going to care if they are forced to give Sony the ability to put in on their subscription? Would Sony even want to (ignoring the costs involved) put it on their subscription in only the UK and alienate the rest of the world who wouldn’t have it available on their subscription as well?
The only note I’d make on this is that I think Deathloop was likely under contractual obligations, it’d be hard to argue that Microsoft gets credit for sharing on that one.
The rest are completely right though, and there’s even more Bethesda games than you listed on the service. So there is not only a decent selection of Bethesda games on PS+ right now but one of them (Fallout 76) wasn’t added until well after the acquisition closed meaning it was very likely negotiated under Microsoft, and given how long it’s been since the acquisition without any Bethesda games leaving the service either Sony had lengthy multi-year deala in place or the deal was re-upped with Microsoft at some point.
Not only that, some Bethesda games are coming to Amazon Prime Gaming and Epic Games Store for free.
Got a list of which ones I missed? Wrt Deathloop, hard to know if it was something contracted out beforehand or not. It definitely cold be, but nonetheless the claim CMA makes there is that it has never once happened which shouldn’t matter anyhow but as it turns out is not at all close to true. Makes me think this ‘research’ was done only before Sony launched their own service this past spring maybe? I dunno.
Most likely, interestingly enough, do we have information available on the CMA’s decision for Sony’s acquisition of Bungie. I wonder if there was any concern with Sony preventing Bungie’s games from releasing on GamePass. Would be interesting if the same concerns weren’t founded in that review.
Allegedly there was no CMA review since Bungie had no point of presence in the territory.
Which has me wonder what should happen if Activision merely relocates all their CMA-region studios outside the area.

Are these dudes for real? Other than the fact that Tom mentioned, exclusive content is 101 for subscription services. Are they gonna regulate streaming services now?
Idk, but if they blocked this deal, it might be best to pull out of said market until some objectivity returns to the governing bodies. If a country is going to actively stifle your ability to compete based on completely hypothetical arguments, I can see reasons to take your business elsewhere.
All on PS+? I wonder about Luna and Stadia now too.
EDIT: DOOM, DOOM Eternal, DOOM 64, ESO, Wolfenstein Youngblood, Rage 2 are all on Stadia too.
I am almost more tired of some of the talking points about how the deal might be dead because the CMA has some surface level concerns.
Yup, it includes both PS+ Extra and Premium, presumably some of the older stuff is streaming only.

Only one I knew was eternal as that was one of the games Google used to highlight Stadia’s capabilities
All prior to MS buying them, but they did keep them on the service. Worth noting their phrasing is that none are available on other services, not that they did not authorize them to be on other services themselves. At best, it is super sloppy and misses several notable titles and at worst the claim was not given a second look at all.
This is getting tiring

They are making such stupid and false claims which are outright lies
Deathloop came to ps+ before it even arrived on Gamepass
They will be ripped apart if this case ever went to court
I hope there are some mindful people at CMA in phase 2 which won’t let this happen and save the institute some embarassment
With how out of touch the CMA is with the gaming industry I would be surprised if the acquisition even finalizes before the end of the fiscal year.
I still think there is a chance, it is just that in Phase 2, MS will take their time demolishing every arguments the CMA may have.
